:) Thanks for coming to court. I never take that for granted.
Leaving Carrollton Municipal Court then heading to Arlington and then to drug court in Dallas County. Busy morning for a Friday!
Just finished doing another Carrollton jail release. Attorney bonds posted. Client is standing on the sidewalk outside the jail and we will take her case to court to try to keep them from making her problem worse.
Filed a Motion to Suppress on a couple of Tarrant County cases today. Officer made a good stop but a bad Terry Frisk. A Terry Frisk allows an officer to do a limited pat down for weapons for the purposes of maintaining the officer's safety during their investigation. But if they exceed the scope of that very limited search they can get into the territory of unreasonable and impermissible search. That is what this officer did and found drugs as a result. We're seeking to have that suppressed.
I won a jury trial in Carrollton today on a speeding. Client was 23 years old driving a Dodge Hemi Challenger 106 mph on the George Bush Tollway (on an occupational driver's license.) I made a big deal about the officer not bringing in dashcam video but the real goal was to distract the prosecutor long enough to get a directed verdict. The judge went out for about 15 minutes to review the tape and confer with the other judge before coming back and granting my motion. The jury was at first confused and then pissed. I'll take tough judges who are fair over soft judges who aren't any day!
Heading to Lew Sterrett to file a writ of habeas corpus to set a bond on a person being held in the Carrollton Jail on a DWI charge.
Two out of three cases dismissed in Carrollton today. Dismissals are rare here.
Posted bonds on tickets from another agency to secure a release on a client in Carrollton Jail.
Resetting cases in Carrollton Municipal Court to allow clients time to get funds together. This court requires money up front on deferred adjudications.
Paid City of Carrollton Municipal Court deferred fees for our clients to get their traffic ticket cases dismissed at the end of their deferreds. In the suburbs, being a criminal defense attorney is mostly about disposing of Class C misdemeanors. Though many offenses occur in the suburbs, and investigations of crime scenes have to take place out here, felonies and Class A and B misdemeanors are fought at the county courthouses.
