Trying to persuade a prosecutor to dismiss a case that she will surely lose at trial. My client has a defense of property claim under Texas Penal Code, Section 9.41(a). A person has a right to use force when they reasonably believe that force is necessary to prevent another person's unlawful interference with their property. Far better to dump the case today and save us all the time of trial than to waste the taxpayers' money and Court's resources on a certain loss.
